Nuno Calaim Lourenço, a Partner at SRS Legal, has published the book Public Contracts and Competition - A European Perspective at the Almedina publishing house.
The book, which corresponds to the author's PhD thesis, analyses the relationship between public procurement and competition. It takes the perspective of competition law and the solutions that, in this area, can ensure the public purchaser's objective of making an economically efficient purchase.
It starts from a basic observation: we are dealing with two universes of economic regulation that have developed in a disjointed and disjointed way, each very subservient to its own idiosyncrasies and to an operational logic that has compartmentalised their respective fields of action, their intentions and the immediate objectives they both pursue. The study also investigates whether the current legal framework for competition offers the best and most appropriate platform for conforming and disciplining the public sector's procurement activities and whether it effectively guarantees undistorted competition in the markets it uses. It also seeks to clarify whether these rules can be improved in order to provide more effective solutions, and how this can be achieved.
