João Paulo Mioludo, Partner at SRS Advogados, wrote an article for the ECTA Bulletin, an European association that promotes the knowledge and professionalism of the intellectual property law community in the fields of trademarks, designs, copyright and other intellectual property rights, within the European Union.
The article, verified by Filipe Baptista, partner at Baptista, Monteverde & Associados, describes a radical change adopted by the Lisbon Court of Appeal, within the context of trademark opposition proceedings, regarding the comparison of trademarks composed by images and/or figurative elements to assess the likelihood of confusion between trademarks.
"This decision constitutes a case study on this matter, as it abandons the criteria that have traditionally been followed in the last decades. It is possible that this new approach will make school", says João Paulo Mioludo.
