On 24 December 2015, a new EU regulation (2015/2424) of the European Parliament and Council of 16 December 2015 (the "regulation") was published in relation to community trademarks. Some of the more important changes are as follows:
- Community Trademarks will be named EU Trademarks and the Office for Harmonisation in the Internal Market (the "office") will be called the Institute of Intellectual Property of the European Union.
-The fee for an application for EU mark registration will now include only one class of products / services, instead of the three that are currently included.
- The fees payable to the Office are as set out in the Regulation; the online application for the registration of a EU trademark will cost €850.
- The online renewal fees for EU Trademarks will cost €850.
- EU Trademark applications can only be submitted at the Institute of Intellectual Property of the European Union; national institutes will no longer be able to receive those applications.
The Regulation will enter into force 90 days after publication (23 March 2016).
